Welcome to Ovader Watch Co. (“Company,” “we,” “our,” or “us”). By accessing or purchasing from our website, you agree to the following Terms of Service.
1. GENERAL CONDITIONS
By using this website, you confirm that you are at least 18 years old and legally capable of entering into this agreement. We reserve the right to refuse service to anyone for any reason at any time.
2. PRODUCTS & SERVICES
Ovader Watch Co. creates custom watches incorporating customer-provided materials, including but not limited to ashes, soil, or sand. Each product is: Custom-made, Unique, Non-returnable except in cases of defect or error
3. CUSTOMER-SUPPLIED MATERIALS
By submitting materials to Ovader Watch Co., you agree that: You have the legal right and authority to provide such materials, The materials are safe, legal, and properly handled, Ovader Watch Co. is not responsible for verifying the origin or ownership of materials. We will handle all materials with care and respect; however: We are not liable for loss, damage, or destruction during shipping or initial processing, Small amounts of material may not be recoverable after production.
As part of our production process, Ovader Watch Co. may create multiple material inlays (“Emberite™ inlay”) to ensure the highest quality final product. Any unused material or additional inlays may be securely retained for up to one (1) year from the date of order completion. This retention is intended to: Support potential repairs or remakes, Maintain consistency in the event of warranty claims. After the one (1) year period, Ovader Watch Co. may contact the customer with options to: Have any remaining materials or inlays returned, Request continued storage (if available), Authorize respectful handling or disposal. If no response is received within a reasonable time, Ovader Watch Co. reserves the right to respectfully handle any remaining materials in accordance with standard practices. Ovader Watch Co. will not use customer materials for any purpose other than fulfilling the original order unless explicitly authorized
4. ORDER PROCESS
Orders are processed only after payment is received. Due to the custom nature of the product: Production times may vary, Delays may occur, We are not responsible for delays caused by shipping carriers or external factors.
5. PRICING & PAYMENT
All prices are listed in USD. We reserve the right to change pricing at any time. Payment must be made in full at the time of order.
6. RETURNS & REFUNDS
Due to the custom nature of our products: All sales are final, No returns or exchanges are accepted. Exceptions may be made in cases of: Manufacturing defects, Incorrect order fulfillment. You may request a refund only during the period between placing your order and the commencement of production. Once materials have been processed or work has started, no refunds will be issued. If a refund is granted, please note that it will not be a full refund of the purchase price. Upon order placement, a non-refundable prepaid shipping label is immediately generated and paid for to facilitate the transit of your materials. Consequently, the cost of this shipping fee will be deducted from your total refund amount.
7. INTELLECTUAL PROPERTY
All content, designs, logos, and materials associated with Ovader Watch Co. are the property of the Company and may not be used or reproduced without permission.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Ovader Watch Co. shall not be liable for: Any indirect or consequential damages, Loss or damage of customer-supplied materials, Emotional distress related to the use of our services
9. GOVERNING LAW
These Terms shall be governed by the laws of the State of South Carolina, without regard to conflict of law principles.
10. CHANGES TO TERMS
We reserve the right to update or modify these Terms at any time. Continued use of the website constitutes acceptance of those changes.
